1. Introduction

Welcome to Feedloopy (“Feedloopy”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Feedloopy platform, including our websites at www.feedloopy.com and app.feedloopy.com, mobile experiences, QR-powered interactions, and all associated services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Definitions

• “User” means any individual who accesses or uses the Service.
• “Business” means any merchant, restaurant, café, hotel, gym, salon, retail store, or other entity that uses Feedloopy to engage with customers.
• “Platform” means the Feedloopy technology infrastructure, software, and services.
• “Loyalty Program” means any points-based, stamp-based, or reward-based program made available through the Platform by a Business.
• “Digital Wallet” means the in-app area where Users may view accumulated rewards, points, benefits, and offers.
• “Reward” means any prize, discount, offer, or benefit offered by a Business through the Platform.
• “Content” means any text, review, rating, feedback, or other material submitted by a User.

3. Eligibility

The Service is intended for users aged 16 or older. By using the Service, you represent that you meet this age requirement. Users under 18 must have parental or guardian consent where required by applicable law. Feedloopy reserves the right to verify eligibility and restrict access where necessary.

4. Account Registration

Some features require providing personal information such as your name, email address, phone number, and date of birth. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of any credentials associated with your account.

5. User Responsibilities

You agree to use the Service lawfully, honestly, and in a manner consistent with these Terms. You are solely responsible for any Content you submit and any actions taken through your account. You must not impersonate any person or misrepresent your identity.

6. Acceptable Use Policy

You must not use the Service to:

• Engage in fraud, abuse, or manipulation of any promotion, loyalty program, or sweepstakes.
• Submit false, misleading, or defamatory Content.
• Attempt to reverse-engineer, scrape, or interfere with the Platform.
• Violate any applicable law or regulation.
• Use automated tools to interact with the Service without our prior written consent.

Feedloopy may suspend or terminate accounts involved in fraud, abuse, or any violation of these Terms without prior notice.

7. Loyalty Programs

Loyalty Programs are operated by individual Businesses using the Feedloopy Platform. Feedloopy acts solely as the technology provider and is not responsible for the terms, availability, or fulfilment of any Loyalty Program. Loyalty points and stamps have no monetary value unless explicitly stated by the relevant Business. Points may expire according to the rules set by each Business. Feedloopy does not guarantee the continued availability of any Loyalty Program.

8. Digital Wallet

The Digital Wallet is a feature that consolidates your Rewards, points, and benefits in one place. The contents of your Digital Wallet are subject to the terms of each individual Business. Feedloopy does not guarantee the redemption value or continued availability of any Wallet contents. Items in the Digital Wallet may expire and are non-transferable unless explicitly stated.

9. Sweepstakes, Giveaways and Instant Rewards

Participation in sweepstakes, giveaways, and instant reward experiences is governed by the rules established by the participating Business. Feedloopy provides the technology to facilitate these experiences but is not the organiser, sponsor, or guarantor of any prize. Rewards may be subject to availability, expiry dates, and additional conditions set by the Business. Feedloopy reserves the right to void prizes in cases of fraud or system error.

10. Reviews, Ratings and User Content

By submitting Content through the Platform, you grant Feedloopy a worldwide, non-exclusive, royalty-free licence to use, display, and process such Content for the purposes of operating and improving the Service. You represent that you own or have the right to submit all Content. Feedloopy reserves the right to remove Content that violates these Terms or applicable law.

11. Intellectual Property

All intellectual property rights in the Platform, including but not limited to software, design, trademarks, and content created by Feedloopy, are owned by or licensed to Feedloopy. Nothing in these Terms grants you any right to use Feedloopy's intellectual property without prior written consent.

12. Third-Party Businesses

Feedloopy is a technology platform. Businesses that use Feedloopy are independent third parties responsible for their own products, services, rewards, and promotions. Feedloopy does not endorse any Business and is not liable for any act or omission of a Business. Any dispute regarding a Reward, purchase, or experience should be directed to the relevant Business.

13. Promotional Campaigns

Promotional campaigns available through the Platform are subject to specific terms communicated at the time of each campaign. Feedloopy reserves the right to modify, cancel, or suspend any campaign at any time. Participation in campaigns may be subject to geographic or eligibility restrictions.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Feedloopy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising from your use of or inability to use the Service. Feedloopy's total aggregate liability shall not exceed the greater of EUR 100 or the amount paid by you to Feedloopy in the twelve months preceding the claim.

15. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. Feedloopy does not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components. Feedloopy does not guarantee the accuracy or completeness of any information on the Platform.

16. Suspension and Termination

Feedloopy may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Platform or other users. Upon termination, your rights to use the Service cease immediately.

17. Data Protection

Your use of the Service is also subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

18. Changes to the Service

Feedloopy reserves the right to modify, suspend, or discontinue the Service or any part thereof at any time. We will endeavour to provide reasonable notice of material changes where practicable. Continued use of the Service following any modification constitutes acceptance of the updated Terms.

19. Governing Law
